These Subscription Terms of Service ("Terms") are a binding agreement between Airspace Acuity LLC, a Florida limited liability company ("Company," "we," "us," or "our"), and the individual or organization ("Subscriber," "you") that creates an account, subscribes to any paid plan, or otherwise accesses the Airspace Acuity platform (the "Service"), located at airspaceacuity.com. Your use of the Service is also governed by the Company's Privacy Policy, available at airspaceacuity.com/privacy (the "Privacy Policy"), which is incorporated into these Terms by reference.
BY CREATING AN ACCOUNT OR SUBSCRIBING, YOU AGREE TO THESE TERMS, INCLUDING SECTION 7 (DATA ACCURACY AND AI-SOURCING DISCLOSURE), SECTION 8 (DISCLAIMER OF WARRANTIES), AND SECTION 9 (LIMITATION OF LIABILITY). IF YOU DO NOT AGREE, DO NOT SUBSCRIBE TO OR USE THE SERVICE.
Airspace Acuity is a data aggregation and analysis platform that compiles, enriches, and presents publicly available records from the Federal Aviation Administration's Obstruction Evaluation / Airport Airspace Analysis ("OE/AAA") database (authorized by 49 U.S.C. § 44718 and disclosed to the public in general pursuant to the FAA's Privacy Act routine uses), together with certain third-party datasets (including, without limitation, NOAA NEXRAD and FAA aeronautical navigation facility data), for the convenience of energy infrastructure developers, consultants, and other industry participants.
The Service is an information convenience tool. It is not an engineering, surveying, legal, or regulatory-compliance service.
Access to the Service is offered in the tiers described below. Features and limits may change from time to time with notice posted to the Service.
Subscriptions renew automatically at the stated cadence until cancelled. Renewal terms — including the renewal price and how to cancel — are described at the time of purchase, and we will obtain your express consent to automatic renewal before charging a renewal term.
Cancellation takes effect at the end of the current paid period; fees paid are non-refundable except as required by applicable law. You may cancel from the Account page or by email to inquiries@airspaceacuity.com. You retain access to the Service through the end of the current paid period.
Fees are stated in U.S. dollars and are exclusive of applicable taxes, which are your responsibility where applicable. We may modify pricing for subsequent periods with at least thirty (30) days' advance notice. If you do not agree to a price change, you may cancel before the next renewal takes effect.
Subscribers may use Airspace Acuity data internally for project planning, site evaluation, and permitting support. You agree not to:
The Service, its software, and its compiled, organized, and enriched datasets are the property of the Company or its licensors. While the underlying government data remains in the public domain, the selection, arrangement, enrichment, cross-referencing, and derived analytics constitute original work protected by copyright and trade secret law. Underlying government records remain public records of the originating agencies.
Subscribers receive a limited, non-exclusive, non-transferable license to use Service outputs for their internal business purposes, subject to these Terms. The methodologies, algorithms, and data processing techniques employed by the Company are proprietary and confidential. Reverse engineering, decompilation, or extraction of these methods is prohibited.
Customer Data. You retain all right, title, and interest in the data and content you upload to or create within the Service, including project boundaries, watchlist entries, and labels ("Customer Data"). We use Customer Data only to provide, maintain, and secure the Service, and we will not use Customer Data to train machine learning models or AI systems. Any suggestions or feedback you provide about the Service may be used by us without restriction, provided such use does not incorporate your Customer Data.
Nothing in these Terms restricts your use of the underlying FAA or other government records obtained directly from the originating agency. The restrictions in Sections 4 and 5 apply only to the Company's compiled, enriched, and organized dataset and Service.
YOU ACKNOWLEDGE AND AGREE THAT:
7.1 Data is aggregated to the best of our ability but is not guaranteed to be accurate, complete, or current. The Service compiles data from public FAA OE/AAA records and other third-party sources. Source records may contain errors, omissions, or delays, which are reproduced in the Service. Filing statuses change; records are updated on our periodic refresh cycles, not in real time, and the Service may not reflect the most recent status of any filing at the moment you view it.
7.2 Derived fields, including sponsor company attribution, may be sourced incorrectly. Certain fields — including, without limitation, sponsor company names — are inferred by automated/AI methods, including inference from sponsor email domains and contact information contained in FAA records. Such inferences may be wrong, outdated, or misattributed (for example, where personnel have changed employers or share third-party email domains). You must independently verify any derived field before relying on it.
7.3 The Service is not a substitute for independent verification, site investigation, or professional advice. Data must not be used as the sole basis for decisions involving safety, airspace navigation, investment, financing, permitting, regulatory compliance, or legal rights. You are solely responsible for verifying all data through primary sources (including the FAA and licensed professionals) before any such reliance.
7.4 No safety-critical use. The Service is not authorized for use in or in support of safety-critical systems, flight operations, or navigation. Use in such contexts is strictly at your own risk and expressly disclaimed by us.
7.5 Project Boundary Data Security. For Enterprise subscribers, uploaded project boundary (KML/KMZ) geometry is encrypted at rest using organization-scoped encryption keys and is accessible only within the subscriber's organization through the Service. Airspace Acuity personnel may access stored boundary data where reasonably necessary to provide, maintain, or secure the Service (for example, database administration or support). You are responsible for safeguarding your account credentials; boundary encryption keys are stored and managed by the Company.
7.6 Predictive and Automated Analysis Tools. Certain features of the Service, including the "Filing Forensics" analytics and automated project boundary intersection analysis, generate estimates, forecasts, and automated screening results by applying statistical models to historical public records. Such outputs: (a) are informational only and are based on data that may be incomplete, outdated, or inaccurate; (b) are not guarantees, representations, or warranties regarding what any company will or will not file, build, or construct, or regarding the actual outcome, cost, or capacity of any project; and (c) may differ materially from actual results. Automated boundary analysis results are algorithmic screenings of publicly available data and are not certified airspace studies, engineering analyses, surveys, or regulatory determinations. You assume all risk of any decision made in reliance on predictive estimates or automated analysis results, including decisions involving substantial capital, investment, financing, or permitting. You should independently verify such information and consult appropriate professional advisers before relying on it.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL DATA ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL BE ACCURATE, COMPLETE, OR CURRENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
9.1 IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITY, LOST OR CORRUPTED DATA, DELAY DAMAGES, LOST OR DELAYED PROJECT REVENUE, LOSSES FROM ADVERSE FAA DETERMINATIONS OR PERMITTING OR FINANCING DELAYS, OR COST OF SUBSTITUTE SERVICES — ARISING OUT OF OR RELATED TO THE SERVICE, THE DATA, OR ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON DATA, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.2 OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED, FOR PRO AND ENTERPRISE SUBSCRIBERS, THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE FEES ACTUALLY PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, AND FOR FREE TRIAL USERS, ZERO DOLLARS ($0).
9.3 SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your breach of these Terms; or (c) your reliance on Service data in violation of Section 7.
11.1 Open-Source Software Components. The Service incorporates open-source software components, including without limitation MapLibre GL JS (BSD-3-Clause License), deck.gl, react-map-gl, and Turf.js (MIT License), and PostGIS (GPLv2, used server-side). Each component is subject to its own license terms, which neither restrict your use of the Service nor grant you any additional rights in the Service. Copyright notices and license texts for these components are provided in Appendix A and available on request.
11.2 Map Data and Attribution. Map displays within the Service incorporate third-party data, including OpenStreetMap (© OpenStreetMap contributors, licensed under the Open Database License), CARTO basemaps (© CARTO, © OpenStreetMap contributors), and Esri World Imagery. Attribution is displayed within the Service as required by those providers' licenses and terms. You may not remove or obscure such attribution, copy or cache map tiles, or extract or republish map data from the Service.
11.3 Geocoding Service. Location search within the Service uses the OpenStreetMap Foundation's Nominatim geocoding service through Company-controlled infrastructure, in accordance with the OSM Foundation's public usage policy (including rate limits and application identification). Search results are used solely to position map views for the requesting user and are cached transiently (up to 30 days) as individual lookups for performance. The Company does not create, aggregate, sell, redistribute, or otherwise compile any derivative database of geocoding results, and OpenStreetMap data is attributed within the Service.
11.4 As-Is. All third-party components, data, and services are provided "as is" by their respective providers, are not endorsed by them, and are subject to any applicable terms of those providers. We make no representations regarding them beyond what is stated in these Terms.
We may modify the Service at any time. We may update these Terms from time to time. For material changes, we will provide at least thirty (30) days' advance notice by email to the address on your account and/or a prominent notice in the Service, describing what changed and when the changes take effect. If you do not agree to a change, you may close your account before the effective date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. Non-material changes (such as typographical corrections or clarifications) take effect when posted.
We may suspend or terminate your access for breach of these Terms, non-payment, or misuse. Except where suspension is necessary for security reasons, we will provide reasonable notice and an opportunity to cure non-payment or curable breaches (at least fifteen (15) days). Upon termination, your license to use Service outputs ends, you must cease all use of Service outputs and permanently delete or destroy copies of Service outputs in your possession or control (other than Customer Data, which you may export as provided below), Enterprise API/MCP keys will be revoked, and we will provide a reasonable opportunity (at least thirty (30) days) for you to export Customer Data through the Service before deletion, subject to our Privacy Policy.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida. You waive any right to participate in a class action to the extent permitted by law.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service, superseding prior agreements.
