These API & MCP Terms ("API Terms") supplement and are incorporated by reference into the Terms of Service ("ToS"). They govern your access to and use of the Airspace Acuity application programming interface ("API") and Model Context Protocol server ("MCP Server") (together, the "Programmatic Interfaces"), accessed through API keys (prefix aa_api_) and MCP keys (prefix aa_mcp_) issued to Enterprise subscribers. Capitalized terms have the meanings given in the ToS. In the event of a conflict, these API Terms govern with respect to the Programmatic Interfaces.
Use of the Programmatic Interfaces requires an active Enterprise subscription and acceptance of these API Terms.
Keys are issued from the Account page and are tied to your organization. You must: (a) store keys securely and treat them as passwords; (b) not share keys with any unauthorized person, agent, or third party; (c) use keys only for your organization's authorized users and AI agents; and (d) notify us immediately at inquiries@airspaceacuity.com if a key is lost, compromised, or misused. You are responsible for all activity that occurs under your keys, including activity by AI agents you authorize.
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access the Programmatic Interfaces and receive output, solely for your organization's internal business purposes. This license does not extend to affiliates or subsidiaries unless expressly agreed in writing. Output is subject to the use restrictions in the ToS (Sections 4 and 5) and Section 4 below. No ownership rights are transferred.
You agree not to, and not to permit any user or agent to:
Rate limits apply per tier and per key as described in the ToS and documentation (currently: Enterprise 3,000 requests per minute per key and 100,000 rows per day per organization; Pro 600 requests per minute and 50,000 rows per day; Free 100 requests per minute on the sample dataset). We reserve the right to throttle, suspend, or terminate access for usage that exceeds programmatic limits or otherwise harms the platform. We may monitor call volumes, access patterns, and application behavior to enforce these terms and protect the platform, its users, and its data.
We may modify the Programmatic Interfaces, add or change capabilities, and update documentation. For breaking changes, we will provide at least thirty (30) days' advance notice by email and in the changelog; changes required for security may be made immediately. Non-breaking, additive changes may be made without notice.
We may suspend access immediately without advance notice where necessary for security reasons or where your use threatens the platform, its users, or its data. We may terminate access for breach of these API Terms or the ToS, and may terminate access for convenience upon thirty (30) days' notice. Upon termination, all keys are revoked and the license in Section 3 ends. Sections 4, 5, 8, and 9 survive termination.
We may monitor usage of the Programmatic Interfaces for enforcement, security, and platform protection. For subscribers with a signed Master Services Agreement, we may verify compliance through documentation review upon reasonable notice.
The Programmatic Interfaces, the platform, and all data made available through them are and remain the property of Airspace Acuity LLC or its licensors, as described in the ToS Section 5.
No service-level agreement applies to the Programmatic Interfaces, and their availability is not guaranteed. They are provided "as is" under the warranty disclaimer and liability provisions of the ToS Sections 8 and 9, which apply fully to your use of the Programmatic Interfaces. Predictive and analysis outputs obtained through the Programmatic Interfaces (including filing forensics forecasts and boundary intersection results) are statistical estimates derived from historical data and are informational only — not guarantees, and not a basis for decisions involving substantial capital without independent verification (ToS Section 7.6).
